Cheercrew creates personalized, custom-made greeting videos based on the photos, messages, and instructions that you provide. When we refer to "we", "us", or "our", we mean Cheercrew. When we refer to "you" or "your", we mean the person accessing our Services or placing an order.

3. Eligibility

By using our Services, you confirm that you are at least 16 years of age, or that you are using our Services with the consent and supervision of a parent or legal guardian, and that you have the legal capacity to enter into a binding agreement.

4. Our Products and Services

Our products are personalized, made-to-order digital greeting videos. Each video is produced individually based on the details you submit at checkout, including but not limited to the team you select, the photo you upload, the message you provide, and any additional options you choose. Because each video is created specifically for you, please review your order details carefully before completing your purchase.

5. Orders and Content You Provide

When you place an order, you may upload photos, provide text, choose songs, and give other instructions (your "Content"). By submitting your Content to us, you confirm and warrant that:

- You own your Content, or you have obtained all necessary rights, permissions, and consents to use it and to allow us to use it for the purpose of creating your video;
- Every identifiable person appearing in, or referenced by, your Content has given their consent to appear in a greeting video;
- Your Content does not infringe the rights of any third party and does not violate any applicable law.

You grant us a limited license to use, reproduce, edit, and process your Content solely for the purpose of producing and delivering your order and providing customer support.

6. Acceptable Use

You agree not to use our Services, and not to submit any Content, that is unlawful, defamatory, harassing, hateful, discriminatory, sexually explicit, threatening, or otherwise objectionable, and you agree not to request any video that promotes violence, illegal activity, or the infringement of any third party's rights. We reserve the right to refuse, cancel, or decline any order, at our sole discretion, that we reasonably believe violates these Terms, and to refund such an order where appropriate.

7. Intellectual Property

All content on our website, including our brand name, logo, text, graphics, and design, is owned by or licensed to Cheercrew and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our materials without our prior written permission. You retain ownership of the Content you submit, subject to the license you grant to us under these Terms.

8. Pricing and Payment

All prices are displayed on our website and are subject to change at any time without prior notice. Payment is required in full at the time of ordering. We use trusted third-party payment providers to process payments securely, and we do not store your full payment card details. By placing an order, you confirm that the payment information you provide is accurate and that you are authorized to use the chosen payment method.

9. Production and Delivery

Once your order and payment are received, our production team will create your video. Estimated delivery times are provided for guidance only and are not guaranteed. Your finished video will be delivered to the email address you provide at checkout. It is your responsibility to ensure that the email address you provide is correct and to check your spam, junk, and promotions folders before contacting us about a missing video.

10. Production Methods and Enhancements

Our production teams use a range of tools, techniques, and technologies to film, edit, and enhance our videos. Some or all of our videos may be AI-enhanced, meaning that artificial intelligence tools may be used as part of the filming, editing, enhancement, or production process in order to improve or refine the final result.

11. Refunds and Cancellations

Refunds and cancellations are governed by our separate Refund & Cancellation Policy, which forms part of these Terms. Please note that, because our videos are personalized and made specifically for you, a video that has already been ordered and received can no longer be cancelled or refunded, as it has already been produced.

12. Disclaimers

Our Services are provided on an "as is" and "as available" basis. While we work hard to deliver high-quality, joyful videos, we do not warrant that our Services will be uninterrupted, error-free, or that the final video will meet every subjective expectation. To the fullest extent permitted by law, we disclaim all warranties not expressly set out in these Terms.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Cheercrew shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Services or any order placed with us. To the extent that any liability cannot be excluded, our total liability to you shall not exceed the total amount you paid for the order giving rise to the claim.
